HAWAII COUNTY COUNCIL agenda item for December 17, 2014

Bill 302: AMENDS CHAPTER 14 (GENERAL WELFARE), ARTICLE 4 OF THE HAWAI‘I COUNTY CODE 1983 (2005 EDITION, AS AMENDED) RELATING TO PROHIBITION OF SMOKING IN CERTAIN PLACES AND THE USE OF ELECTRONIC SMOKING DEVICES – Prohibits the use of electronic smoking devices in all enclosed and partially enclosed places within the County where use of tobacco products are currently prohibited, and also prohibits use of electronic smoking devices at all County parks and recreational facilities.

INSIGHTS

This bill is a carry over from the previous council, who voted it up to second reading. Since the new council took office, two councilmembers who voted in favor of the bill on first reading (J Yoshimoto and Brenda Ford) are no longer in office. If passed by the council and signed into law by the mayor, the use of electronic smoking devices shall be prohibited from all enclosed places within the County, much like traditional smoking is now.

After talking it over, the council voted 6 to 2 in favor of the bill. The no votes came from Hilo councilman Dennis “Fresh” Onishi and Puna councilman Greggor Ilagan. Councilmember Zendo Kern, who is no longer on the council, was absent.

“Electronic smoking devices” means any electronic product that can be used to simulate smoking in the delivery of nicotine or other substances to the person inhaling from the device including but not limited to and electronic cigarette, electronic cigar, electronic cigarillo or electronic pipe, and any cartridge or other component of the device or related product.Ammended language proposed for Chapter 14, article 4, section 14-20 of the Hawaii County Code 1983 2005 Edition, as amended)
